1 · Who you are contracting with

NeverMissACall.ie is operated by ElevateIreland, a registered business name of Bartlomiej Standa, business name number 790663, registered with the Companies Registration Office in Ireland.

In these terms, "we" and "us" mean ElevateIreland. "You" means the business subscribing to the service. "Caller" means a person who telephones your line and speaks to the receptionist.

2 · What the service is

We provide an AI receptionist that answers telephone calls to your business when you do not, takes the caller's details and what they need, and sends that to you by text message and in your account.

The receptionist produces derived outputs — a summary, a job type, an urgency, a suggested next step. These are generated by AI and are probabilistic. They can be wrong. You are responsible for reading them before acting on them.

3 · Demo calls

This clause matters more than its length suggests, because it is the one part of the service that telephones somebody who is not yet a customer.

4 · What it runs on

The service depends on third parties. An incident affecting any of them can affect the service, and we cannot fix their outages. The current list is in Sub-processors and may change.

5 · Recording and AI disclosure

Calls answered by the receptionist are recorded, so that you can hear what was actually said rather than take our word for it.

7 · Price, billing and refunds

The price is the one on your quote. A setup fee and a monthly, agreed with you before anything is built. Nothing per call, nothing per minute.

When billing starts

Your setup fee and first month are charged when you go ahead on your quote. That day is day one of your billing month, and the monthly runs from it.

Nothing is charged before you have agreed the figures. Our own test calls and your own test calls never cost you anything.

If we get it wrong

If we charge you something you did not agree to, tell us. We refund that charge in full and add €50 in credit. We would rather be told than be right.

8 · What it will not do

The receptionist is not an emergency service and must not be relied on as one. If there is a smell of gas, ring Gas Networks Ireland on 1800 20 50 50. If there is danger from electricity, ring ESB Networks on 1800 372 999. If anyone is at risk, ring 999 or 112.

It does not give medical, legal or financial advice, does not quote prices or commit to arrival times on your behalf, and does not claim any certification you hold. It takes jobs; it does not attend them.

9 · Liability

The service is provided as it is. We do not warrant that it will be uninterrupted or error-free, or that its outputs will always be accurate.

11 · Law and disputes

Irish law governs these terms and the Irish courts have exclusive jurisdiction. Before anything formal, tell us what is wrong — almost everything is fixable in a phone call.

We may update these terms by posting a new version here. If a change materially reduces what you get or increases what you pay, you may cancel before it takes effect.

12 · Privacy notice

Two different people appear in this notice: you, our customer, and your caller, who never chose to deal with us at all. The second one gets the same care as the first.

Who is responsible for what

For your own account — your name, your business, your billing — we are the controller.

For your callers' details, you are the controller and we are your processor. We handle that data on your instructions to deliver the service, and clause 13 sets out the terms on which we do it.

Why we are allowed to

For your callers, you decide the lawful basis, because you are the controller. Most businesses rely on legitimate interests for taking and recording a customer enquiry. It is worth writing down why.

Who else sees it

Only the providers that make a call happen, listed in Sub-processors. None of them get it to sell, and we do not sell or rent personal data to anybody, ever.

Where it goes

Our own records are held in the EU. Some providers in the chain are outside it — a live call is processed by systems in the United States in order to reach you at all. Where that happens we rely on the transfer safeguards in those providers' terms. Ask us and we will tell you exactly which providers and where.

Your rights, and your caller's

You can ask what we hold, ask for a copy, ask us to correct it, ask us to delete it, ask us to restrict what we do with it, or object. One message does it, it costs nothing, and we will answer within a month.

If one of your callers asks us directly, we will pass it to you, because you are the controller — and we will help you answer it.

If you think we have handled data badly, tell us first; we would far rather fix it. You can also complain to the Data Protection Commission, who regulate this in Ireland, at dataprotection.ie.

Automated decisions

The receptionist classifies calls — urgent or not, a job or an enquiry. That is categorisation to help you act, not a decision with legal effect on anybody. Nothing here makes a decision about a person that we expect you to follow without reading it.

Children

The site and the service are for businesses and are not directed at children.

13 · Data processing terms

These apply where we process your callers' personal data on your behalf, and form part of the agreement between us.

We will: act only on your documented instructions; keep it confidential; apply appropriate technical and organisational security; tell you about a personal data breach without undue delay; help you answer data subject requests and, where needed, a data protection impact assessment; allow reasonable audit; and delete or return the data when the agreement ends.

You give general authorisation for us to use the sub-processors listed below. If we add or replace one, we update that list, and that update is the notice. If a change materially worsens your position and we cannot accommodate a reasonable objection, you may cancel and we refund anything you have paid for the period after.

15 · Cookie policy

This is a short policy because this is a short list. We set one cookie without asking, and one advertising tracker only if you say yes.

The Meta pixel does not load until you accept it. Before you answer, and for as long as your answer is no, nothing on this site is fetched from Meta and nothing about your visit is sent to them. That is the whole of it — no session replay, no other third-party analytics, nothing sold to anybody.

Changed your mind, either way? The Cookies link in the footer reopens the choice. Switch to no and we delete Meta's cookies and reload the page without the pixel, there and then.

The sample dashboard pages we show during a demo carry no tracking at all, whatever you answered — there is nothing to accept on them, so they have no Cookies link either.

Stripe sets its own cookies on its payment page for fraud prevention. That page is Stripe's, not ours, and their policy applies to it.
